Workers Comp for California Tutoring Centers
Tutoring Centers offer an important service for children, teens, and adults looking to further their educational career. There are different types of Tutoring Centers, which have different Workers Comp needs. We will go over some of the basics you need to know if you own or manage a California Tutoring Center.
Workers Comp for California Tutoring Centers – Who Should Be Covered
In California, you are required to carry Workers Comp for all of your employees. Many Tutoring Centers are unique in that hire independent contractors to work as tutors for their company. These independent contractors may not be employees but they should still be covered under a Workers Comp policy. In general, when you have independent contractors, the Workers Comp carrier will want to include their payroll unless they carry their own Workers Comp. This is important to remember, because if you withhold the independent contractor payroll, the carrier may discover and then include the payroll at the end of year audit.
Workers Comp for California Tutoring Centers – Classifications
Every employee of your Tutoring Center should have a classification in order to be included on the Workers Comp. The classification will dictate the rate and carrier eligibility for these employees. Tutoring Center employees are typically classified as 8868, schools or colleges. It is important to check with your Agent/Broker to confirm the class codes being used, as the rate for different class codes can vary substantially. If you aren’t sure which class code to use, you can always contact the Workers Comp Insurance Rating Bureau of California (WCIRB) for assistance, as they are the organization that establishes these class codes.
Workers Comp for California Tutoring Centers – Carrier Eligibility
Another important part of purchasing Workers Comp for a Tutoring Center is carrier eligibility. Some carriers have specific requirements while others would decline to offer coverage for the same risk. This can be an issue if you do not properly explain your operations while applying for coverage. For example, if you offer residential in-home tutoring services, some carriers may decline to offer coverage or non-renew your policy when they find out about the off-premises operations.
Alternately, if you have a dedicated Tutoring Center, you may be able to get a quote approved that would otherwise have been declined with the carrier.
